The Franklin County Sheriff's Office is investigating an accidental shooting at a Moneta residence Friday afternoon.
Herbert Aragon Jr., 37, was shot and killed at his residence on Peak's View Drive when his girlfriend mistook him for an intruder, according to Lt. Phillip Young.
The woman told investigators that after giving her toddler a bath, she noticed the front door of the residence was open, Young said. The woman said she had locked the door before going into the bathroom.
Fearing that an intruder had entered the house, the woman retrieved a handgun from the bedroom and began checking the house, Young said.
The woman was startled when she encountered a man in the house, so she fired the handgun at him, Young said.
The man was later identified as Aragon, who had returned home early and unannounced from a business trip, Young said. Aragon was later pronounced dead at the scene.
No charges have been filed against the woman, Young said. She and her son were transported to Carilion Franklin Memorial Hospital for evaluation.
The investigation is ongoing.
