Austin indicted on two more meth charges

A Callaway man was indicted Monday by a Franklin County grand jury on two felony drug charges related to a raid on a suspected meth lab in Rocky Mount last November.

Frank Wendell Austin, 40, is charged with manufacturing methamphetamine and possession of methamphetamine with intent to distribute.

Investigators raided the suspected methamphetamine lab at a residence on Walnut Street on Nov. 29, 2012.

Acting on a tip of suspicious activity at the residence, investigators with the Rocky Mount Police Department were conducting surveillance, according to Lt. Todd Maxey with the Franklin County Sheriff's Office. The investigators requested assistance from Sgt. Brandt Gawor with the sheriff's office.

When Gawor responded, he observed several subjects fleeing the area, Maxey said. Gawor observed Austin inside the garage, along with items associated with the manufacture of methamphetamine.

Investigators obtained and executed a search warrant at the residence, Maxey said.

With assistance from a special agent with the Virginia State Police, investigators seized bottles, funnels, chemicals and a white, powdered substance believed to be methamphetamine from the garage of the residence, Maxey said.

Austin was indicted in March on two drug charges stemming from a raid on another suspected meth lab at a residence on Swenfield Road in Callaway in January.

In that case, Austin is charged with possession of methamphetamine with intent to distribute and possession of chemical ingredients used in the manufacture of methamphetamine.

When deputies and special agents with the Virginia State Police executed a search warrant in January, they seized equipment and chemicals used in the manufacture of methamphetamine from a detached garage at the Callaway residence, Maxey said. Deputies also seized a white, powdery substance believed to be methamphetamine.

An indictment in not a finding of guilt, but it is a determination by jurors that enough evidence exists to warrant a trial.

Other indictments returned by the grand jury:

•Hunter D. Adams, refuse to permit a sample of blood or breath to be taken to determine the alcohol or drug or both drug or alcohol content of the blood after having been arrested for driving under the influence, Nov. 19, 2012; operate a motor vehicle under the influence of alcohol or other self-administered intoxicants after having been convicted previously on two or more occasions within the last five years, Nov. 19, 2012; possession of marijuana, Nov. 19, 2012.

•Dorothy Underwood Barnett, drive or operate a motor vehicle on the highway after her driver's license had been suspended or revoked and having previously been convicted of driving while her driver's license had been suspended or revoked on two or more prior occasions, April 10.

•Luther Robert Brown III, draw, utter or deliver a check with the intent to defraud knowing at the time there were insufficient funds in the account to pay, Nov. 28, 2012.

•Tracy Michelle Carson, two counts of utter a forged Virginia Uniform Summons, March 30: drive a motor vehicle on the highways after having her privilege to drive suspended or revoked, March 30; and use the identifying information of another person to avoid summons, arrest, prosecution or to impede a criminal investigation, March 30.

•Samantha Colquitt, refuse to permit a sample of blood or breath to be taken to determine the alcohol or drug or both content of the blood, March 13.

•Jeremie Lawrence Flora, two counts of fail to reregister after having a previous conviction for failure to reregister after having been convicted of a sexually violent offense, March 29 and April 27.

•Bobby Garrett Greer, break and enter a residence or building attached to the residence with the intent to commit larceny, March 21; and take, steal and carry away goods and chattels having a value in excess of $200, March 21.

•Ivan Hernandez-Guillermo, willfully sexually abuse a 13-year-old child by force, threat or intimidation, Feb. 1 to April 22.

•Julia Krystal Hamby, trespass or remain upon property of another after having been forbidden to do so, Nov. 11, 2012.

•Betty Marie Hartman, sell personal property upon which there is a lien with the intent to defraud, Dec. 5, 2012.

•Douglas David Henry, injure and destroy property having a value in excess of $1,000, April 11, 2011.

•Kelli Dillon Hodges, cause or permit the life of a child to be endangered, Feb. 6; damage, deface or destroy property having a value of less than $1,000, Feb. 6; unlawfully possess Lidocaine, Feb. 6; possess a hypodermic syringe or needle, Feb. 6; and take, steal and carry away goods and chattels having a value of less than $200, Feb. 6.

•Shaun Keith Hudson, sell or dispose of personal property upon which there is a lien with the intent to defraud, April 16, 2012.

•Amy Michelle Johnson, distribute oxycodone, Feb. 15; possess cocaine, Feb.15; and drive a motor vehicle on the highway after having her privilege to do so suspended or revoked and having two or more prior convictions for driving suspended or revoked within the last 10 years, Feb. 15.

•Demetrius Anthony Kelsaw, without the intent to steal but with the intent to temporarily deprive the owner, use a motor vehicle having a value in excess of $200, Oct. 20, 2012; drive a motor vehicle upon the highway after his privilege to operate a motor vehicle had been suspended or revoked, Oct. 20, 2012; and refuse to permit a sample of his blood or breath to be taken to determine the alcohol or drug content of his blood, Oct. 20, 2012.

•Jason Wayne Kendrick, take, steal and carry away goods and chattels having a value of less than $200 after having been convicted once before of larceny, Feb. 6.

•Anthony Keith Lowe, fail to register with the Virginia State Police and local law enforcement for being a convicted sexually non-violent offender, March 19.

•Bobby Joe Lynch, possession of methamphetamine with the intent to distribute, March 26.

•Robert Steven Marcey, with the intent to maim, disfigure, disable or kill, cut and wound another person, Dec. 14, 2012.

•Joie Lynn McLaughlin, fail to appear in Franklin County Juvenile and Domestic Relations Court while charged with a felony, March 19.

•Corey Trey Mullins, take, steal and carry away goods and chattels having a value in excess $200, March 6.

•Demitrus Antwane Preston, forge a check with the intent to defraud, April 10; and utter a forged check with the intent to defraud, April 10.

•Brittany Alexander Smith, with the intent to maim, disfigure, disable or kill, cause bodily injury to another person, Dec. 7, 2012.

•Kristen Javon Tolliver, three counts of while having custody of a child under the age of 18, willfully or negligently cause or permit the life of the child to be endangered or the health of the child to be injured, April 16.

•Travis Jerrad Turnage, with the intent to maim, disfigure, disable or kill, cause bodily injury to another person, Dec. 7, 2012.

•Haywood David Welch III, assault a law enforcement officer while the officer was engaged in the performance of his public duties, March 11.

•Jacob Daniel Wermann, drive a motor vehicle on the highway after his privilege to do so had been suspended or revoked, Feb. 8; and possess marijuana, Feb. 8.
