A Moneta man will serve three years of a 10-year sentence for fondling a young girl last November.
Brian W. McMillian, 35, pleaded guilty to taking indecent liberties with a child under the age of 13 Monday in Franklin County Circuit Court.
McMillian was also sentenced to five years probation and ordered to be of good behavior for 13 years, according to Assistant Commonwealth's Attorney Robert Deatherage.
Judge W.N. Alexander II also ordered McMillian to complete sex offender treatment and have no contact with the victim or any unsupervised minors, Deatherage said. He will be registered as a sex offender.
McMillian pleaded guilty through an agreement with the Franklin County Commonwealth's Attorney's Office, Deatherage said. The prosecution accepted the plea because the mother did not want her child to testify, he added.
"The girl is in therapy and is doing well," Deatherage said. "We did not want to subject her to the trauma all over again."
The incident occurred on Nov. 22, 2012, when McMillian was keeping the child while her mother was Christmas shopping, Deatherage said.
