A Rocky Mount man will serve two years and four months of an 11-year sentence for having sex without force with a 13-year-old girl.
Ronald Leon Underwood Jr., 19, was sentenced to two years and six months on each of four counts of having carnal knowledge of the child. He also was sentenced to 12 months in jail for proposing sex with the girl over a cell phone.
Circuit Court Judge W.N. Alexander II suspended all the prison time, except two years and four months.
After his release from prison, Underwood will be on probation for three years and was ordered to be of good behavior for 10 years.
Underwood must also register as a sex offender with the Virginia State Police and local law enforcement.
Underwood pleaded guilty to the charges in November 2012 through an agreement that stipulated that he would serve no more that six years and six months in prison.
The incidents occurred between June 1, 2011, and July 31, 2011, Commonwealth's Attorney Tim Allen said.
Prosecutors learned about the incidents when the mother of the girl discovered disturbing text messages from Underwood on her daughter's phone, Allen said. The mother brought the cell phone to the Franklin County Sheriff's Office, where the messages were downloaded.
During interviews with investigators, Underwood admitted to having sex with the 13-year-old girl four times at her parents' residence in Penhook, Allen said.
Evidence also showed that Underwood asked the girl for nude photos, and he used his cell phone to ask the girl to have sex with him.
