A Fieldale man will be committed for psychological evaluation before being sentenced for the rape of a 12-year-old girl.
Timothy Lee Stallard, 25, pleaded guilty in June to two counts of rape, two counts of sodomy and two counts of taking indecent liberties with a 12-year-old girl.
During his sentencing hearing Wednesday in Franklin County Circuit Court, Judge W.N. Alexander II told Stallard he questioned his mental stability and competency, based on a presentence report compiled by a probation officer.
Alexander ordered Stallard to be committed to a mental health facility until he is "restored," at which time Stallard will be sentenced on the charges.
Although each rape charge carries a maximum prison sentence of life, a minimum of five years must be served, according to Assistant Commonwealth's Attorney Patrick Nix. The sodomy charges also carry a maximum life sentence and a 5-year minimum.
The two counts of taking indecent liberties with a minor each carries a maximum sentence of 10 years, Nix said.
The Code of Virginia states that any person who has sexual intercourse with a child under the age of 13 shall be guilty of rape.
The charges to which Stallard pleaded guilty occurred on Jan. 11 and Jan. 26.
The victim's mother became suspicious when she learned that Stallard and her daughter had been communicating on a social website, professing to love each other, Nix said.
Investigators with the Franklin County Sheriff's Office interviewed the victim, who said Stallard had sexual intercourse with her at least 10 times, Nix said. But Stallard admitted to investigators that he had sexual relations with the victim at least 30 times. |
