Hardy man indicted on involuntary manslaughter count

A Hardy man was indicted by a Franklin County grand jury Monday on charges of involuntary manslaughter and reckless driving in connection with a wreck in which a Boones Mill youth was killed.

The indictment on the count of involuntary manslaughter states that Joseph Tyler Rogers "did kill and slay Brian White against the peace and dignity of the commonwealth" on May 22, 2007.

Rogers was 18 years old at the time of the wreck, and White, who was a passenger in the vehicle driven by Rogers, was 16 years old.

A second indictment against Rogers states that on May 22, 2007 Rogers, " did drive a vehicle on a highway recklessly or at a speed or in a manner so as to endanger the life, limb or property of another person."

Rogers was driving a 2007 Mustang west on Grassy Hill Road (Route 919), sixth-tenths of a mile from Route 220 Business, when Rogers lost control of the vehicle, crossed into the eastbound lane and sideswiped a 1999 Volkswagen Beetle driven by Laura Joan Harden, 51, of Boones Mill, according to Trooper R.D. Conley with the Virginia State Police. The Mustang then ran off the eastbound shoulder of the road, struck several trees and overturned.

Harden and a third passenger in the Mustang escaped without injury. Rogers was treated at Carilion Franklin Memorial Hospital for minor injuries, Conley said.

White, who was not wearing a seatbelt, was partially ejected from the vehicle, the trooper said.

The grand jury also indicted John David Hodges Jr., 39, of Rocky Mount on counts of murder, use of a firearm in the commission of a felony and possession of a firearm after being convicted of a felony.

Hodges is charged with murder in connection with the Feb. 16 shooting death of Paten Thomas Hodges, 49, in the parking lot of One Stop Shop convenience store at the intersection of Doe Run and Tripple Creek roads.

An indictment is not a finding of guilt, but is a determination by jurors that enough evidence exists to hold a trial.

Other indictments returned by the grand jury:

"Ricky Lee Atkins, possession of more than one half-ounce but less than five pounds of marijuana with intent to distribute, Aug. 9, 2007; and possession of a pistol while in possession with the intent to distribute more than one pound of marijuana, Aug. 9, 2007.

"Zachary Stewart Adkins, break and enter a storehouse with the intent to commit larceny, Oct. 17, 2007.

"Scott Ray Bogle, possession of a firearm after having been convicted of a violent felony, Feb. 3, 2008; swear falsely to a material matter in the case of Commonwealth v. Bogle in Franklin County General District Court, May 1, 2008.

"Dagan James Brooks, break and enter a storehouse with the intent to commit larceny, Jan. 21, 2008; take, steal and carry away chattels having a value in excess of $200, Jan. 21, 2008; remove, deface, destroy, alter, change or obliterate the model, serial number or any other identification mark on a firearm, Jan. 21, 2008.

"Cynthia E. Clark, unlawfully obtain hydromorphone hydrochloride ( Dilaudid), Dec. 29, 2007; unlawfully obtain Dilaudid, Jan. 3, 2008; unlawfully obtain Morphine, Jan. 3, 2008 and Dec. 29, 2007.

"Charlie William Craighead, operate a motor vehicle on the highway after having been found to be an habitual offender and having been convicted of driving after having been found an habitual offender, April 26, 2008.

"Roger Earle Davis, operate a motor vehicle on the highway after having been found to be an habitual offender and having been convicted previously of driving after having been found an habitual offender, Oct. 10, 2007 and Feb. 21, 2008.

"Ricky Franklin Dillon, unlawfully possess methamphetamine, Oct. 22, 2007; allow a child under the age of 18 to be present in the same dwelling house during the manufacture of methamphetamine, Aug. 1, 2007; manufacture methamphetamine, during October 2007.

"Brent Ray Doss, take, steal and carry away goods and chattels having a value in excess of $200, March 31, 2008; and take, steal and carry away goods and chattels having a value less than $200, March 31, 2008.

"Marie Forbes, allow livestock owned by her or under her control to stray into the highway or public property or private premises of another or did fail to sufficiently confine a fence livestock to prevent the same from trespassing or straying, April 30, 2008.

"Michelle Ivy Hancock, interfere or obstruct a probation officer in the discharge of his duties or concealed a child in order that he could not be brought before the juvenile court of Franklin County, March 24, 2008.

"Tiffany Nicole Handy, take, steal and carry away goods and chattels having a value in excess of $200, March 31, 2008; take, steal and carry away goods and chattels having a value less than $200, March 31, 2008; and unlawfully possess Aderall, Percocet 3 and Nicodin, March 31, 2008.

"Danny Lee Hensley, unlawfully possess Dihydrocodeinone and Oxycodone Aug. 9, 2007; possess a pistol while in possession with the intent to distribute more than one pound of marijuana, Aug. 9, 2007; possess with the intent to distribute more than one-half ounce but less five pounds of marijuana, Aug. 9, 2007.

"Nicholas Thomas Holmes, possess with the intent to distribute cocaine, March 28, 2008

"Steven Andrew Hudson, operate a motor vehicle under the influence after having been previously convicted on two or more occasions within the last 10 years, Nov. 23, 2007.

"James Christopher Hunt, unlawfully and feloniously did operate a motor vehicle under the influence of alcohol, Jan. 14, 2008; and did fail to immediately stop at the scene of an accident in which a person was injured, Jan. 14, 2008.

"Charity Boswell Massey, did possess cocaine, Dec. 19, 2007.

"Thomas Frank May Jr., did take, steal and carry away chattels having a value in excess of $200, Jan. 26, 2008; and break and enter a storehouse with intent to commit larceny, Jan. 26, 2008.

"Tabitha Dawn Miller, did receive goods and services obtained from another's credit card account, Dec. 14, 2007.
